Terms of Use

Last reviewed: October 2, 2026

1. Acceptance of these terms

These Terms of Use (“Terms”) govern access to and use of the website located at tpassessments.ca (the “Site”), operated by TruePoint Assessments (“TruePoint,” “we,” “us” or “our”). By accessing or using the Site, submitting a referral, or completing any form on the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

2. Nature of our services

TruePoint arranges and coordinates independent medical, psychological and rehabilitation assessments, conducted by regulated health professionals, on behalf of third parties such as lawyers, insurers and employers. The Site itself is an informational and intake tool: it describes our services, lets referral sources submit referrals, and gives people being assessed information about what to expect. The Site does not itself provide an assessment, diagnosis, opinion or report; those are provided only by a qualified assessor as part of an actual engagement.

3. No medical advice; no treatment relationship

Nothing on this Site constitutes medical, psychological, legal or other professional advice, and using this Site does not create a physician-patient, therapist-client, or other treating relationship between you and TruePoint or any assessor.

Assessments arranged through TruePoint are conducted to provide an independent professional opinion to the party that requested the assessment. They are not a substitute for your own medical care, and if you have a health concern you should consult your own treating health care provider. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department.

4. Eligibility & use of this website

You may use this Site only for its intended purposes: learning about our services, submitting a referral or inquiry in good faith, and finding information relevant to an assessment you or someone you represent is attending. You must be at least 18 years old, or using the Site on behalf of an organization with authority to do so, to submit a referral or any form on this Site.

5. Referrals & form submissions

When you submit a referral or any other form through this Site, you represent and warrant that:

  • the information you provide is accurate and complete to the best of your knowledge;
  • if you are submitting information about another person (including an individual to be assessed), you have the appropriate authority, consent or legal basis to provide that information to us for the purpose of arranging an assessment;
  • you will not use the Site’s forms to submit fraudulent, abusive or unlawful requests.

Submitting a referral is a request, not a guarantee of a scheduled assessment; scheduling is confirmed separately by our intake team once a request is reviewed. We reserve the right to decline any request at our discretion, including where we are unable to match an appropriate assessor or where required information is missing.

6. Intellectual property

All content on this Site — including text, graphics, logos and the design of the Site itself — is owned by or licensed to TruePoint and is protected by copyright and other intellectual property laws, unless otherwise indicated. You may view and print pages of the Site for your own personal, non-commercial use in connection with a referral or assessment, but may not otherwise copy, reproduce, republish or distribute content from the Site without our prior written permission.

7. Acceptable use

You agree not to:

  • use the Site in any way that violates applicable law;
  • attempt to gain unauthorized access to any part of the Site, our systems, or any account not belonging to you;
  • interfere with or disrupt the Site’s operation, including by introducing malware or attempting a denial-of-service attack;
  • scrape, data-mine, or use automated means to extract content from the Site without our permission;
  • impersonate any person or misrepresent your affiliation with any person or organization in a referral or form submission.

8. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, TruePoint disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that information on the Site is complete, accurate or current at all times.

9. Limitation of liability

To the fullest extent permitted by law, TruePoint and its directors, officers, employees and the independent assessors it engages will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of (or inability to use) the Site, whether based on contract, tort, negligence, strict liability or otherwise, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or wilful misconduct.

10. Indemnification

You agree to indemnify and hold harmless TruePoint and its directors, officers, employees and engaged assessors from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your submission of inaccurate or unauthorized information through the Site.

11. Privacy

Our collection, use and disclosure of personal information in connection with the Site is described in our Privacy Policy.

12. Changes to these terms

We may update these Terms from time to time. The “last reviewed” date at the top of this page shows when it was last updated. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

13. Governing law & jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts of Ontario.

14. Severability & entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TruePoint regarding use of the Site, and supersede any prior agreements on this subject.
